What are the laws surrounding care home waste management? 

Care home managers have a legal obligation to oversee effective healthcare waste management within their facility. This responsibility comes under several UK regulations, including: 

• Environmental Protection Act 1990: Requires waste-producing facilities to store, transport, and dispose of their waste safely. This should be done using licensed carriers such as ourselves and following approved disposal routes.
• Hazardous Waste Regulations 2005: This set of guidelines applies to clinical and pharmaceutical waste in care homes, such as infectious materials and used medicines.
• Controlled Waste (England and Wales) Regulations 2012: Defines how different waste streams should be classified and segregated to prevent harm.
• Health and Social Care Act 2008: Legislation enforced by the Care Quality Commission (CQC) requiring care providers to manage waste in a way that protects others. 

Since these are legal requirements, failure to comply can result in enforcement notices, fines, reputational damage, and even prosecution or facility shut-down. 

What are the different types of healthcare waste that care homes encounter, and how should they be disposed of?

Clinical waste 

Clinical waste must be placed in colour-coded infectious waste bags and collected by a licensed contractor for safe disposal. Our orange and yellow waste disposal bags are suitable for heavy-duty clinical waste that requires heat treatment prior to incineration and disposal.  

Common examples of care home clinical waste include dressings, gloves, swabs, PPE, and any other items contaminated with bodily fluids. 

Sharps waste 

Sharps waste, including needles, lancets, and syringes, need to be disposed of using a puncture-resistant sharps container.

To dispose of these items correctly, you must place them in a designated offensive waste bag so they can be collected separately from other clinical waste.
